Service Agreement

Effective date: July 10, 2026

This Service Agreement (the “Agreement”) governs your access to and use of the Lovexai application and related services (collectively, the “Service”). By downloading, installing, or using the Service, you agree to be bound by this Agreement. If you do not agree, do not use the Service.

1. Eligibility — Adults Only

The Service contains adult-oriented, AI-generated content and is strictly limited to users who are at least 18 years old (or the age of majority in your jurisdiction, if higher). By using the Service you represent and warrant that you meet this requirement. We may suspend or terminate accounts we reasonably believe belong to minors.

2. Your Account

An account is created automatically based on a device identifier; no e-mail or password is required. You are responsible for the device you use. If you delete the app or reset your device identifier, your account, balance, and content history may become permanently inaccessible. We cannot restore accounts that are no longer linked to a retrievable device identifier.

3. Virtual Currency

The Service uses virtual items (“Diamonds” and “Points”) that can be purchased through Apple In-App Purchase or earned through in-app activities. Virtual currency has no monetary value, is not redeemable for cash, is non-transferable, and may only be used within the Service. Except where required by applicable law or by the Refund Policy, purchases of virtual currency are final.

4. User Content

You may upload photos (“User Content”) for the purpose of generating images or videos. You represent and warrant that for all User Content:

• you own the content or have obtained every right, license, and permission needed to use it with the Service;
• every identifiable person depicted is an adult (18+) who has given you explicit, informed consent to the use of their likeness for AI-generated adult content;
• it does not depict any minor, and does not include content that is illegal, non-consensual, or infringing in any jurisdiction.

Uploading content that depicts minors, or using another person’s likeness without consent, is strictly prohibited, will result in immediate and permanent termination without refund, and may be reported to law enforcement where required by law.

5. AI-Generated Content

Output produced by the Service is synthetic media generated by machine learning models. Output may be inaccurate, unrealistic, or contain artifacts; results are not guaranteed. Subject to this Agreement and applicable law, you may use output for personal, non-commercial purposes. You are solely responsible for how you use, share, or publish output, including compliance with the laws of your jurisdiction (including laws governing synthetic or manipulated media).

6. Prohibited Conduct

You agree not to:

• violate any applicable law or regulation;
• upload or attempt to generate content involving minors, real persons without consent, or non-consensual scenarios presented as real;
• use output to harass, defame, extort, impersonate, or harm any person;
• reverse engineer, scrape, overload, or interfere with the Service, or circumvent any technical or rate-limiting measure;
• resell or commercially exploit the Service without our consent.

7. Content Moderation and Enforcement

We may review, filter, refuse, or remove any User Content or generated output, and may suspend or terminate access, at our discretion, to enforce this Agreement or comply with law. Diamonds spent on a generation that fails for technical reasons are refunded automatically to your in-app balance.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by us or our licensors. You retain rights you hold in your User Content and grant us a limited, worldwide, royalty-free license to host, process, and transform it solely to operate and improve the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately for breach of this Agreement. Sections 4–10 and 12 survive termination.

12. Changes and Contact

We may update this Agreement from time to time; the “Effective date” above reflects the latest revision, and continued use after changes constitutes acceptance. Questions about this Agreement: support@lovexai.app.
